Terms of Use and Privacy Policy

Terms of Use for Kusuri no Lady Heart Shop Main Store

Lady Drug Store Co., Ltd. (hereinafter referred to as the "Company") establishes terms ("these Terms") concerning the use of "Kusuri no Lady Heart Shop Main Store," operated by the Company as follows:

Article 1 (Definitions)

For the purpose of these Terms, the terms listed below shall have the following meanings. "Heart Shop Main Store" shall refer to a system incorporating functions for posting product or service information and for providing products or services online, which is also a website administered by the Company on the Internet in accordance with these Terms. "Users" shall refer to people accessing Heart Shop Main Store. "Services" shall refer to services supplied by the Company to people using Heart Shop Main Store under these Terms. The content and type of the Services is subject to modification, expansion or reduction at the sole discretion of the Company.

Article 2 (Scope and Modification of these Terms)

  1. These Terms shall apply to the Company and Users in connection with the use of the Services, and Users shall faithfully observe these Terms when using Heart Shop Main Store.
  2. Individual provisions, separately presented on Heart Shop Main Store, or otherwise provided by the Company, as well as other provisions added by the Company, shall form a part of these Terms. In case of any conflict between these Terms and any of the individual and added provisions, the said individual or added provision shall prevail.
  3. The Company may, at its own discretion, modify these Terms without consent from Users.
  4. The Company shall not be liable for any disadvantage or harm caused to Users as a result of such modification.

Article 3 (Users' Status and Restrictions)

  1. Users' status
    By using any of the offered Services (for the purpose of this Article, "use" shall include "view browsing"), Users shall be deemed to accept these Terms and shall obtain the status of User in connection with Heart Shop Main Store.
  2. Restrictions on Users
    Users shall not engage in any of the following acts:
    (1) Any act of using Heart Shop Main Store in methods other than those specified by Heart Shop Main Store.
    (2) Any act of pretending to be another person in using the Services.
    (3) Any act of establishing a link of data related to the Services to other data in methods other than those specified by Heart Shop Main Store.
    (4) Any act that results or may result in unauthorized access or damage to data stored by Heart Shop Main Store.
    (5) Any act of interfering with operations of the Services.
    (6) Business activities which use the Services without approval of the Company, any act of using the Services for commercial purposes, and any act of using the Services in preparation for the act mentioned above.
    (7) Any act of collecting, accumulating, or trying to collect and accumulate personal information of other Users.
    (8) Any act that is contrary to public order and morals, or violates domestic or foreign laws and regulations.

Article 4 (Communication)

Article 6 (Refund and Return)

In the case of any damage or loss during packaging and transportation, initial defects, or incorrect delivery, Users may return the goods to the Company C.O.D., after notifying the Company by telephone or email within eight days of delivery; provided, however, that the Users shall be responsible for the shipping fee in the case of returns for their convenience, such as differing from their expectation, the wrong size, or an incorrect order.
Please return the goods to the Company after notifying the Company by telephone or email within eight days of delivery. Upon receipt of the returned goods, the Company shall start refund procedures in the order of such receipt. It may take ten to twenty business days from Users' dispatch of the goods to completion of the refund procedures. In cases where Users have paid by credit card, it may require additional days, according to the credit card company response.
The Company does not accept returns in the following cases:

  1. If eight days have passed since Users' receipt of the product.
  2. If the product is damaged or corrupted due to Users' fault.
  3. If Users have already opened the package or used the product.

Article 7 (Transfer of Ownership)

Ownership of all products purchased by Users from Heart Shop Main Store shall be transferred to the Users when the purchased products are transferred to the courier by Heart Shop Main Store, regardless of the method of payment or delivery method selected by the Users.

Article 8 (Termination)

In event of any of the following, the Company may cancel or terminate any sales contract that is already executed, or take other appropriate measures, without giving prior notice to the relevant User:

  1. If the User violates these Terms.
  2. If any personal information provided by the User is found to be false.
  3. If good reason is discovered to believe that the User may lose capacity to pay.
  4. If the products cannot be delivered because of an unknown address, or the User's long-term absence.
  5. If the User's payment cannot be confirmed in the case of products requiring payment in advance.
  6. If a credit card company designated by the User notifies the Company of an error of credit authorization.
  7. If the User's order involves products which are unlikely to be shipped for an extended period, or cease to be produced (please note that products which are purchasable at the time of receipt of the order may cease to be purchasable during order processing).
  8. If the User's order exceeds limitation on the purchase quantity, if any, including limited supply products.
  9. If the User places an excessively high-volume order which may lead to resale or any other use for commercial purposes.
  10. If the actual selling price is higher than the price stated on the Internet. (Reasonableness of prices shall be determined by the Company.)
  11. If payment is not made prior to the due date in the case of settlement with a due date, including payment by bank transfer and convenience store advance payment.
  12. If the User performs any other unjust or inappropriate act, the Company may cancel or terminate the sales contract, or take other appropriate measures.

Article 9 (Suspension of Provision of the Services and Cancellation of Membership Registration)

If a User falls under any of the following categories, the Company may, without notifying the User in advance, suspend provision of the Services to the User, cancel the User's registration, and take other measures deemed necessary by the Company:

  1. If the User delays payment of fees for the Services or any other monetary obligation, or otherwise goes into default.
  2. If the User performs any of the acts listed in the second paragraph of Article 3 (Restrictions on Users).
  3. If it becomes known that the User violated these Terms in the past.
  4. If the User otherwise violates these Terms.

Article 10 (Withdrawal)

Users desiring to withdraw from membership shall take withdrawal procedures by themselves. Such Users shall be deemed to withdraw when the prescribed withdrawal procedures are completed.

Article 11 (Interruption and Suspension of the Services)

  1. In event of any of the following, the Company may, at its own discretion, temporarily interrupt or suspend all or part of the Services without notifying Users in advance:
    (1) If regular or emergency maintenance or update of equipment and systems for the Services is carried out.
    (2) If provision of the Services is rendered difficult by any event of Force Majeure such as fire, power failure, or natural disaster.
    (3) If the operation of any telecommunications service provider is not available.
    (4) If the Company otherwise determines that temporary interruption or suspension of the Services is required for any operational or technical reasons, or that provision of the Services is difficult due to unforeseen circumstances.
  2. The Company shall not be liable in any way for any disadvantage or harm caused to Users or third parties due to temporary interruption or suspension of provision of the Services, regardless of the reason.

Article 12 (Modification of the Services)

The Company may, without notifying Users in advance, abolish the point system, cease to grant points, change the kinds of transactions generating points, change discount percentages and discount amounts, change the term of validity, and otherwise modify contents of the Services including, but not limited to, points, coupons, selling prices, shipping fees and other fees, and Users shall hereby agree to such modification in advance.
Separately established provisions shall govern the point system.
In addition, when the Services are not available to Users for any reason, Users shall lose all the rights they have in the points they possess, and shall have no claim against the Company.

Article 13 (Handling of Hyperlinks)

Even in cases where there is a hyperlink from various services supplied by Heart Shop Main Store to any other website, or a third party provides a hyperlink to another website, the Company shall not be responsible in any way for websites outside Heart Shop Main Store. In such cases, the Company shall not be responsible in any way for any content, advertisement, product or service incorporated in, or made available on, such websites. Furthermore, the Company shall not be responsible for compensation for damage arising from, or in connection with, any such content, advertisement, product or service.

Article 14 (Copyright)

  1. Users may not, in any way, reproduce, sell, publish or use for other purposes any information provided through Heart Shop Main Store beyond the scope of the Users' personal use set forth in the Copyright Act, without the approval of the copyright holder.
  2. In cases where problems occur due to violation of the provisions of this Article, Users shall, at their own expense and responsibility, resolve the problems and shall not cause any inconvenience or damage to the Company.

Article 15 (Liability)

  1. The Company shall not be liable in any way for damage caused to Users or any third party due to provision, delay, modification, interruption, cancellation, suspension or discontinuation of the Services, or due to leak or loss of supplied information, etc., or otherwise in connection with the Services.
  2. In cases where Users cause any damage to a third party through the use of the Services, the Users shall, at their own expense and responsibility, resolve the problem, and shall not cause any damage to the Company in connection therewith. In cases where Users cause damage to the Company through violation of these Terms or any other unjust or illegal act, the Company may demand that Users compensate for damages, to a reasonable extent.

Article 16 (Privacy Policy)

  1. Any personal information entered by Users in connection with member registration and purchase of products will be collected for the purpose of shipping products, confirmation of Users' age, and to engage in various kinds of sales promotion and verification activities.
  2. Users' information obtained by the Company in connection with the Users' use of the Services shall be managed and handled in accordance with the Privacy Policy separately established by the Company.

Article 17 (Use of Cookies)

Users shall acknowledge that Cookies may be installed for the information system and used by the Company.

Article 18 (Governing Law)

The establishment, validity, performance and interpretation of these Terms shall be governed by Japanese law.

Article 19 (Jurisdiction of Agreement)

In case of any dispute in connection with these Terms, the parties shall agree to submit to the exclusive jurisdiction in the first instance of a district court having jurisdiction over the location of the headquarters of the Company.

About handling of personal information

Privacy Policy of Kusuri no Lady Heart Shop Main Store

In such cases, you may cancel or resume said provision of information concerning services and products by notifying the Company in the method prescribed by the Company.

The Company shall observe laws, regulations and standards applicable to Personal Information handled by the Company, and will improve as needed the measures mentioned above.
